Fort Myers man found guilty of second degree murder after he shot a father in front of his kids


FORT MYERS, Fla. — A Fort Myers man was found guilty of second degree murder with a firearm.

Jose Espichan, 27, was arrested by the Lee County Sheriff’s Office in September 2021 after he shot a father in front of his children at a Lee County gas station.

The incident happened near the intersection of Palm Lane and Orange River Blvd. When deputies arrived on the scene they found the victim, Jesus Milian Cabrera, with multiple gunshot wounds. Despite rescue efforts, Cabrera died at the scene.

Investigators soon located the vehicle involved in the incident, a white Cadillac SUV, on I-75 near the crime scene. Inside the SUV, deputies found Espichan, his girlfriend and two children.

Further investigation revealed the events leading up to the shooting. According to the state attorney’s office, Espichan and his girlfriend were at home when she saw Cabrera’s pick-up truck driven by his father and a car, with Cabrera, his girlfriend and their children inside.

Espichan’s girlfriend had been in a dispute with them about a dog a few weeks before the incident.

Espichan and his girlfriend then got into the SUV and followed the vehicles. After Cabrera stopped near a Circle K to help his father with an issue on the truck, Espichan then yelled at them to move and shot Cabrera.


According to the state attorney’s office, Espichan’s sentencing is scheduled for September 27.
